On June 25, 2019, Schochor, Staton, Goldberg, and Cardea, P.A., P.A achieved a Plaintiff’s Verdict against Ellen Lemkin, MD and Osler Drive Emergency Physicians Associates, P.A. in the amount of $1,750,000.
The case involved a 65-year-old gentleman who presented to St. Joseph Medical Center’s ER for evaluation after suffering chest pain. The patient had a significant cardiac history and multiple risk factors for an aortic dissection. Despite this history, Dr. Lemkin diagnosed him with a simple muscle strain and sent home instead of admitting him for a cardiac evaluation. The ER at St. Joseph Medical Center is staffed by Osler Drive Emergency Associates, P.A. which employed Dr. Lemkin.
A Belated Diagnosis
When the patient returned the following day still in distress, he was diagnosed with a large aortic dissection. He arrested in the ER during this return visit and emergency surgery was unsuccessful.
The belated diagnosis was too little and too late. The patient passed away days later.

The jury awarded the following amounts:
- $1,000,000 for the decedent’s widow (half in non-economic damages, and half for lost wages and loss of household services)
- $250,000 for the decedent’s estate for pain and suffering
- $250,000 non-economic damages for each of his two surviving adult daughters
