Baltimore, MD – Schochor, Staton, Goldberg and Cardea, P.A. today announced that it won a $1.975 million verdict in the Circuit Court for Baltimore County on behalf of a client who suffered life altering injuries as a result of the failure to properly treat a prosthetic joint infection.
The medical malpractice litigation was led by attorneys Michael Rubin and Jonathan Goldberg and centered on the failure to meet the standard of care in properly treating a prosthetic joint infection following hip replacement surgery. The jury found the substandard treatment rendered by Defendants Peter Jay, M.D. and The Centers for Advanced Orthopaedics caused catastrophic, permanent injuries to the plaintiff.
The case (Gerald McCrae, Sr. v. The Centers for Advanced Orthopaedics, LLC, et al.) began following a total right hip replacement surgery for the patient, Gerald McCrae, Sr. Shortly after the surgery, he developed an infection in the prosthetic joint. The standards of care required the Defendants to remove the infected hardware to fully eradicate the infection. Instead, The Defendants chose a different path, performing multiple “washout” procedures while leaving the infected prosthesis in place.
Mr. McCrae’s condition predictably worsened since the infection was not appropriately treated. He was moved to the intensive care unit where he was intubated. He was ultimately taken to surgery, but because the source of the infection (the prosthetic hip) was not timely removed, Mr. McCrae developed debilitating and permanent injuries, including, but not limited to:
- Sepsis and Septic Shock: A life-threatening systemic response to infection.
- End-Organ Failure: Critical damage to the body’s internal systems.
- Stroke: Resulting in permanent neurological impact.
- Permanent Lower Extremity Impairment: Leaving the plaintiff with lasting physical disability.
As a result, the jury awarded a verdict in favor of Mr. McCrae in the amount of $1.975 on January 21, 2026. The verdict included $1 million for pain and suffering, as well as awarding past medical care costs, future medical care costs and lost earnings for the plaintiff.
