Represented by Schochor, Staton, Goldberg, and Cardea, P.A., a former ER and trauma nurse was awarded $2,045,213.51, after a jury found that her orthopedic surgeon, Dr. Navinder Sethi of Potomac Valley Orthopaedic Associates, breached the applicable standards of care and failed to provide appropriate informed consent.

The patient, Patricia Bent, had previously undergone a successful right-sided surgery for right-sided symptoms.  She returned one year later with left-sided symptoms and required surgery only on that side.  Instead, Dr. Sethi recommended and performed a bilateral surgery.  The Plaintiffs alleged that the right-sided portion of the surgery was both unnecessary and particularly risky, given her prior surgery on that side with scar tissue.  Indeed, Mrs. Bent suffered from a right-sided dural tear, which the Plaintiffs alleged would have been avoided had Dr. Sethi acted appropriately and performed a left-sided surgery only.

A Caregiver who Now Requires Care

Ms. Bent has permanent nerve damage and no feeling on her right side from the waist down to her foot.  As a result, the 64-year-old former professional caretaker now requires ongoing care.  She must use a four-wheeled walker for short distances, and longer distances require her to use a wheelchair.  She cannot work, drive, and she can no longer enjoy the recreational activities that were once part of her active lifestyle, such as gardening, boating, and fishing.

Dr. Sethi was found to have breached the applicable standard of care by performing an unnecessary bilateral procedure, and he was found to have failed to provide appropriate informed consent in not offering a left-sided procedure.
