What you need to know about filing a medical malpractice case

First, you should understand there are statutes of limitations in medical malpractice cases. The statute of limitations is the deadline for you to file a claim, or you forever lose the right to do so. They differ between Washington D.C. and Maryland, and there are various rules depending on if the victim is a minor or an adult, and whether the victim died as a result of the negligence.
Our attorneys can give you specific information regarding whether your claim meets the time requirements.

Secondly, you should know that to make a claim of medical malpractice, you will need to prove:
The doctor, hospital, institution or other health care provider acted negligently. In other words, he or she or they made a mistake; and
That mistake caused physical, mental, and/or emotional harm.

So, to file a medical malpractice claim, you will need evidence that proves these elements. The law requires you to build a direct link between the doctor’s negligent actions and the harm done to you. The typical evidence used to prove your case includes:

  • Medical records
  • Medical bills and expenses
  • Witness statements
  • Expert witness testimony.

Senior Managing Partner Jonathan Schochor explains why some hospitals are taking responsibility for medical negligence by voluntarily admitting mistakes. While it’s rare, it seems that some hospitals, surgeons and physicians are trying to change the culture by developing protocols to reduce the chance for a mistake to reoccur. One of the functions that Schochor, Staton, Goldberg and Cardea, P.A. hopes to achieve is to reduce the occurrence of medical malpractice or negligence. Click here to listen.

Diligent and hardworking
I just wanted to send you a note to let you know how happy I was with the work the team, in my case. It was a good outcome but it took awhile, as these things tend to, and throughout it all Wray stayed the course. Not only was he diligent and hardworking, he was very honest and did not sugar coat anything, which I really appreciated. As I am sure you can imagine, being in the position where you feel like you should sue for malpractice is not a comfortable one. He made it easier and I always felt like I was in good hands. Thanks to him, Kristina Tyler for her investigative work and everyone else who worked on the team.

We felt our rights were protected
When my Dad died at the age of 64, my mom had lost her soul mate. My mother, brother, sister and I mourned for our father and there was a deep hole in our hearts and we needed justice to be served. Our children would never be able to see their Grandfather again and memories could no longer be created. Time was slipping away quickly and our 3 year statute of limitations was getting close and we knew time was of essence. At first we were unsure what to do. We had questioned why my father was not referred to a cardiologist when he went to see his primary doctor to be cleared for surgery. His medical records revealed that he had risks for a coronary heart disease yet we were uncertain if our case had substance. We contacted you and after reviewing our case, you saw merit and reached out to us to let us know you wanted to represent us. We felt our rights were protected and you guided us through the entire legal process until the end. I had researched your firm and found your team to possess a set of powerful skills and I felt that you would be the ones who could see us through our matter. You and your law partner James appreciated my father. Both you and James performed remarkably in court throughout the entire trial. I never lost hope. My family stood our ground and we had trust in you because you stayed engaged with us, keeping us informed at every stage in our case. Even though my mother spoke a different language, you were patient, polite and were respectful of both her culture and her religion. Supplying my mom with a translator at deposition helped her immensely. You corresponded with my sister living in another country, kept in touch with me even though I lived in another state and also met face to face with my mother and brother to help us all stay informed. You made thorough investigations, secured the best medical experts and prepared us immaculately at trial. Finally, after the 6 hour jury deliberation, despite that the 2 doctors/defense had a high chance of winning, you nevertheless took us to victory. My family can never thank Schochor, Staton, Goldberg and Cardea, P.A. enough for your representation.
- Mary

I highly recommend this firm for quality legal representation
Our legal team worked cohesively with exceptional skill, preparedness, and professionalism. Most surprising was the incredible personal service we received through a process that was very difficult for our family. At the conclusion of our trial, more than one person (professionals who were present for the proceedings but unaffiliated with this firm) made their way to us and remarked in essence, ‘You were represented by The Best.’ I have no doubt that we were.

Professionalism, honesty, and compassion
Having experienced the tragic and unexpected loss of my father, I turned to Mr. Goldberg of Schochor, Staton, Goldberg, and Cardea, P.A.. Mr. Goldberg was able to help determine the cause of death, and advised me on how best to proceed. The professionalism, honesty, and compassion was most appreciated during a very difficult time. I am so grateful for the referral that led me to the Mr. Goldberg and this wonderful law firm.
- Nancy
I have and would continue to recommend him and the law firm.

- Anna
Kerry Staton fought for my sister and I
He treated us like family and was timely and efficient. Even though he couldn’t change what happened, we knew he was on our side and would do what was right.

We were treated with respect and kindness!
There’s nothing more frustrating then hearing, “these things can happen,” when you or a loved one has been the victim of a medical mistake. From the very minute we met with Schochor, Staton, Goldberg, and Cardea, P.A., he believed my mom truly was a victim of medical malpractice. We were treated with respect and kindness throughout our long legal journey. When trial time came, I could not get over how organized and professional the team was. I actually felt sorry for the defendant who clearly was not feeling the same way about her representation. In comparison to the firm’s typical multi million dollar case, ours was just peanuts. But our case was treated no differently than a big case and was clearly just as much of a win as any other case. If you feel you or a loved one has been a medical victim, don’t hesitate–just call. I promise you will not regret that call!
- Lisa
Outstanding Team of Lawyers

- Marcy
Thank you Schochor, Staton, Goldberg, and Cardea, P.A..
When my mother died unexpectedly, I just couldn’t get what happened out of my head. She went to the top heart doctor in Washington D.C. They claim that it takes only 90 minutes from the time you walk through emergency center doors to receive a heart catheterization. But our mother waited 19 hours, and by then it was too late. Even though I knew I had a case, filing a medical malpractice suit for someone you love is not for the faint of heart. It was one of the most difficult things I have ever done in my life. And that’s saying a lot. The best decision I made in this process was contacting Schochor, Staton, Goldberg, and Cardea, P.A.. Everyone I came into contact with at SSGC couldn’t have been more professional and sympathetic. They were all well aware of the pain and suffering this kind of stuff causes. Any time we needed to stop and take a breath during the trial, they were there. They were there in the trenches with us. And I can’t tell you how important that is when going through something like this.
- Kathleen
Thankfully, we had the lawyers of Schochor, Staton, Goldberg, and Cardea, P.A. on our side.
When you have a child with a spinal cord injury, your life changes forever. Because of a medical error, our son will, for the rest of his life, have to worry about the little things, like how to get around and survive day-to-day—even after we’re no longer able to care for him. After the medical accident, everything became twice as expensive, and insurance only covers so much. You have to worry about things like wheelchairs, making modifications to your house, buying special equipment, physical therapy, and so on. Filing our medical malpractice claim was a grueling process. We started in 2003, and it wasn’t until 2008 that we were finally done. That’s five years of depositions, interviews, motions—it’s a process that consumed us for all that time. Thankfully, we had the lawyers of Schochor, Staton, Goldberg, and Cardea, P.A. on our side. We first went to an attorney at a small firm, and he was the one who recommended we contact SSGC. From the beginning, the entire SSGC team was courteous, professional and supportive. They understood what we were going through, and did all they could to make the process as easy as possible for us. What we appreciated most was that from the beginning, they gave us a realistic view of what we were up against, and what it would take to win. I can’t tell you what a relief it was to have someone tell us the truth. Throughout the long process, the SSGC team kept us informed. Even when we moved across the country halfway through the process, we never felt like we were out of the loop. Most important, they fought hard for us every step of the way. And the settlement they secured for us has gone a long way to help us provide the kind of quality of life we want to provide for our son, no matter what his disabilities. In fact, the special swimming lessons we’re now able to afford helped him win the national junior disability championships. That’s the kind of thing we just can’t put a value on.

We finally got the answers
We really wanted some answers with regard to what happened to my mother. We finally got the answers—she was medically neglected, which resulted in her death. We can rest now knowing what happened to her. The lawyers at Schochor, Staton, Goldberg, and Cardea, P.A. took us step by step from the very beginning. They worked together as a team and were accessible to our family anytime we called and had questions. Their level of respect, sincerity and knowledge is commendable. My advice to people in a similar situation is simply to not wait. Do not hesitate to call Schochor, Staton, Goldberg, and Cardea, P.A. if you feel that medical malpractice may have occurred. They are very kind and genuine people who will guide you through the process and keep your best interests at heart.
- Sarah
I was treated very well by Schochor, Staton, Goldberg, and Cardea, P.A
When you are in a situation like I was—still suffering, still grieving—you want someone to pay attention and care. You want someone to be sympathetic to your cause. I was treated very well by Schochor, Staton, Goldberg, and Cardea, P.A., and would recommend the firm to a friend or acquaintance. Through all phases of the case, my legal team explained each step—it was all very clear and concise. Each member of the team took a lot of time with my family and me. They were very professional and helped us all through a difficult time. I do not wish this on anyone else, but if someone does have to go through something similar, there are a few things I would recommend. First, I would tell them to keep notes when going though something at a hospital or with a doctor. Also, ask a lot of questions and, if the inevitable happens and someone passes away, seek legal counsel immediately. I would also seek legal advice if you think something has been mishandled. I went out to try to justify my husband’s death and let the hospital know that what they did was a terrible thing. The jury verdict we received will never replace my husband or bring him back. But it has helped me come to terms with raising a son on my own.
- Anne
Thank you so very much! Maybe now we can have some closure.
My husband Mark and I cannot express enough how grateful we are to have found such a caring and helpful firm such as Schochor, Staton, Goldberg, and Cardea, P.A.. We were going through a very stressful case and you all made it so much easier and somewhat less painful, and for that we are thankful. The people at SSGC could not possibly have been more helpful, honest, and empathetic. Your firm got results in a very timely and professional way. Everyone who works there—from the front desk to anyone just walking by—are friendly and eager to help. They are all truly assets to you.
- Linda
